1. Acceptance of Terms

By accessing or using AI-Spark ("the Service"), including by creating an account, making a payment, or otherwise using any features of the Service, you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, you must not use the Service.

These Terms constitute a legally binding agreement between you ("you," "your," or "the User") and the operator of AI-Spark ("we," "us," "our," or "AI-Spark"). Please also review our Privacy Policy and Refund Policy, which are incorporated into these Terms by reference.

2. Description of Service

AI-Spark is a SaaS platform that provides AI-powered analysis of Fortnite gameplay videos. The Service allows users to upload video clips of their Fortnite matches; receive AI-generated analysis identifying gameplay mistakes, patterns, and areas for improvement; access personalized AI-generated training plans; and interact with an AI coaching assistant via chat.

All analysis and coaching provided by AI-Spark is advisory and informational only. AI-Spark does not guarantee any specific improvement in gameplay performance, skill rating, or competitive results.
AI-Spark is not affiliated with, endorsed by, or sponsored by Epic Games, Inc. Fortnite is a registered trademark of Epic Games, Inc.
AI-Spark is not a substitute for professional esports coaching, and no professional coaching relationship is created by using the Service.

3. Eligibility and Account Registration

3.1 Minimum Age

You must be at least 16 years old to use the Service. By creating an account, you represent and warrant that you are at least 16 years of age. The Service is not directed to children under 13 years of age, and we do not knowingly collect data from children under 13 (see our Privacy Policy for details).

3.2 Account Responsibility

You are responsible for providing accurate registration information, maintaining the confidentiality of your account credentials, and all activities that occur under your account. You must notify us immediately at aispark.help@gmail.com if you suspect unauthorized use of your account.

3.3 One Account Per User

Each user may maintain only one account. We reserve the right to suspend or terminate duplicate accounts.

4. Subscription Plans and Payment

4.1 Plans

AI-Spark offers the following subscription tiers: Free (limited access), Pro (enhanced access with higher usage limits), and Elite (premium access with the highest usage limits). Details of features, limits, and pricing for each plan are displayed on the pricing page. We reserve the right to modify plan features and pricing at any time, with reasonable notice to existing subscribers.

4.2 Payment Processing

Payments are processed through Lava.top, a third-party payment gateway. By making a purchase, you also agree to Lava.top's terms of service. We do not store your credit card numbers or full payment card details.

4.3 Automatic Renewal

AI-Spark paid subscriptions (Pro and Elite) renew automatically. When you purchase a subscription, you authorize recurring monthly charges at the then-current subscription rate until you cancel. Your subscription will automatically renew at the end of each billing cycle, and your payment method will be charged accordingly. You may cancel at any time through your Lava.top account or by contacting us at aispark.help@gmail.com. Upon cancellation, you retain access to your paid features until the end of the current billing period, after which your account reverts to the Free plan. No further charges will be made after cancellation takes effect.

4.4 Pricing and Currency

All prices are displayed and charged in US Dollars (USD). Applicable taxes, if any, may be added by the payment processor depending on your jurisdiction.

5. Acceptable Use

You agree to use the Service only for its intended purpose and in compliance with all applicable laws. You must not:

Use the Service to upload content that is illegal, infringing, defamatory, obscene, or harmful;
Upload videos that you do not have the right to share or that contain third-party content without authorization;
Attempt to reverse-engineer, decompile, or disassemble any part of the Service;
Use automated scripts, bots, or scraping tools to access the Service;
Attempt to gain unauthorized access to our systems, other users' accounts, or any non-public areas of the Service;
Use the Service in connection with cheating software, exploits, or any tools that violate the terms of Epic Games or any other third party;
Resell, redistribute, or commercially exploit the Service or its outputs without our prior written consent;
Interfere with or disrupt the integrity or performance of the Service;
Harass, abuse, or harm other users or our staff through any communication channels associated with the Service.

We reserve the right to suspend or terminate your account, without refund, if you violate these terms.

6. Intellectual Property

6.1 Our Intellectual Property

All rights, title, and interest in and to the Service — including its software, algorithms, AI models, design, branding, text, graphics, and all other proprietary content — are and remain the exclusive property of AI-Spark and its licensors. You are granted a limited, non-exclusive, non-transferable, revocable license to access and use the Service for your personal, non-commercial purposes in accordance with these Terms.

6.2 Your Content

You retain ownership of the video clips and other content you upload ("Your Content"). By uploading content, you grant AI-Spark a limited, non-exclusive, royalty-free, worldwide license to process, store, and analyze Your Content solely for the purpose of providing the Service to you, and to generate and display AI analysis results derived from Your Content. This license terminates when you delete Your Content or your account. We do not use Your Content to train AI models or for any purpose other than providing the Service to you.

6.3 AI-Generated Outputs

The AI analysis results, training plans, and coaching recommendations generated by the Service ("AI Outputs") are provided to you for your personal use. You may not claim that AI Outputs constitute professional coaching advice or endorsement by Epic Games.

7. Disclaimer of Warranties

THE SERVICE IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS, WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, OR ACCURACY.

Without limiting the foregoing, we do not warrant that the Service will be uninterrupted, error-free, or secure; we do not warrant that AI analysis or recommendations will be accurate, complete, or suitable for any particular purpose; we do not guarantee any specific results from using the Service; and we are not responsible for the accuracy or availability of third-party services (including Fortnite itself).

8. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, AI-Spark's total aggregate liability to you for any and all claims arising out of or related to these Terms or the Service shall not exceed the total amount you have paid to AI-Spark in the twelve (12) months preceding the event giving rise to the claim, or fifty US Dollars (USD $50), whichever is greater.

IN NO EVENT SHALL AI-SPARK BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOSS OF PROFITS, DATA, USE, OR GOODWILL.

Some jurisdictions do not allow the exclusion or limitation of certain warranties or liabilities. If you are a consumer in the EU, UK, or California, nothing in these Terms affects your mandatory statutory rights under applicable consumer protection law.

9. Indemnification

You agree to indemnify, defend, and hold harmless AI-Spark and its operator from and against any claims, damages, losses, liabilities, costs, and expenses (including reasonable attorneys' fees) arising out of or related to your use of the Service, your violation of these Terms, your violation of any applicable law, or content you upload that infringes the rights of a third party.

10. Termination

10.1 By You

You may stop using the Service and delete your account at any time by contacting us at aispark.help@gmail.com or using the account deletion feature in Settings (if available). Deleting your account will result in the removal of your personal data in accordance with our Privacy Policy.

10.2 By Us

We may suspend or terminate your access at any time, with or without notice, for reasons including violation of these Terms, abusive or fraudulent activity, or extended inactivity. If we terminate your account due to your violation of these Terms, you are not entitled to a refund. If we terminate your account without cause during an active paid subscription, you may be entitled to a pro-rata refund for the unused portion in accordance with our Refund Policy.

10.3 Survival

Sections 6 (Intellectual Property), 7 (Disclaimer), 8 (Limitation of Liability), 9 (Indemnification), 11 (Governing Law), and this Section 10.3 shall survive termination of these Terms.

11. Governing Law and Dispute Resolution

We encourage you to contact us at aispark.help@gmail.com before initiating any formal proceedings. We are committed to resolving disputes informally and in good faith whenever possible.

These Terms are governed by the laws applicable at the place of the Service operator's residence, except where overridden by mandatory consumer protection laws of your jurisdiction.

If you are a consumer in the European Union or the United Kingdom, nothing in these Terms limits your rights under the mandatory consumer protection laws of your country of residence, including the right to bring proceedings in your local courts. If you are a consumer in California, your rights under the California Consumer Legal Remedies Act, the CCPA/CPRA, and other applicable California consumer protection statutes are preserved.

Any dispute that cannot be resolved informally shall be submitted to the competent courts or, where both parties agree, to binding arbitration under the rules of a recognized international arbitration institution. Nothing in this section prevents you from filing a complaint with a consumer protection authority in your jurisdiction.

12. Changes to These Terms

We may update these Terms from time to time. When we make material changes, we will post the updated Terms with a new "Last Updated" date and notify you via email or an in-app notice at least 14 days before the changes take effect. Your continued use of the Service after the updated Terms take effect constitutes your acceptance of the changes.

13. Miscellaneous

Severability: If any provision is found unenforceable, the remaining provisions continue in full force.
Entire Agreement: These Terms, together with the Privacy Policy and Refund Policy, constitute the entire agreement regarding the Service.
Waiver: Our failure to enforce any right or provision shall not be considered a waiver.
Assignment: You may not assign these Terms without our prior written consent. We may assign our rights and obligations without restriction.
